The Chief Magistrate, Mrs Akanni Olaide, sentenced the accused, who attacked his victim with a machete, after he pleaded guilty to the allegation of theft.

“The defendant is convicted as charged; he is hereby sentenced to three months imprisonment with a fine option of N2, 000.

“He is a first time offender and having pleaded for mercy; however, the court will not let you go unpunished.

“This is to serve as a deterrent to others,’ the magistrate said.

Earlier, the prosecutor, Mrs A. Adewunmi-Aliko said that the convict was reported in a Bwari Police Station on Dec. 21, 2015 by one Isah Surajo of Sabon Gari, Bwari.

She said: “On Nov. 9, 2015 at about 9 p.m., the complainant conveyed Garba on his commercial motorcycle.

“But before they got to their destination, Garba asked the complainant to stop on the way and attacked him with a cutlass from his trousers to dispossess him of the motorcycle.

“He then forcefully took the motorcycle and fled.”

The prosecutor further told the court that the motorcycle was found with the convict at the time of his arrest.

She said that the offence contravened Section 290 of the Penal Code.

The defendant, who had pleaded guilty to the charge told the court that it was “ the work of the devil.

“I have never done such a thing in my life before; it was actually my first time and I am full of regret now.

“Please have mercy on me,” Garba pleaded. (NAN)
